Cedar Falls man gets deferred sentence for credit card thefts

A Cedar Falls man who pleaded guilty to stealing almost $3,500 through the fraudulent use of credit cards has been sentenced to probation and could qualify for a deferred sentence.

James Robert Vilmain II, age 38, was sentenced Friday in Floyd County District Court on a conviction of credit card fraud, a Class D felony.

Judge Peter Newell sentenced him to up to three years probation, ordered him to abstain from the use of illegal drugs and be subject to random drug testing, and issued a civil penalty of $750, which was fully suspended.

Vilmain was also ordered to pay $2,546.91 in restitution to Wilson Transport Inc.

A deferred sentence means that if Vilmain meets all the terms of his probation he will have the conviction and charge removed from his public criminal record.

Vilmain had been arrested in November 2019 and charged with using two credit cards that he had kept after being terminated from employment with the Charles City trucking company.

The criminal complaint filed in district court said Vilmain charged items totaling $3,491.39 between May 2 and May 30, and was identified using the cards on store security cameras.
