Floyd, Cerro Gordo Counties tell drainage district attorney to get his job done

Late Tuesday morning, the Floyd County Board of Supervisors held a special board meeting that included a conference call with the Cerro Gordo County Board of Supervisors and Attorney Jim Hudson. The two boards have been working with Hudson for more than two years concerning their joint drainage district.

Hudson was asked to file paperwork with a railroad company concerning a culvert that needed to be replaced.

“This is clearly a case where railroad needs to comply,” Hudson told the supervisors.

However, the railroad has not received legal notice making them aware of their responsibilities to replace the culvert in question. Hudson admitted fault.

“I apologize to everybody,” Hudson said during the conference call.

According to Floyd County Auditor Gloria Carr, Hudson was to have sent the notice in January of 2015.

“I’m a little embarrassed,” Hudson said, continuing his apology. “I’m hoping to get notices out this week and get them served.”

“We need to move forward with this or we need to find new legal counsel,” Floyd County Supervisor Roy Schwickerath said, responding to Hudson’s apologies. At which point, Hudson ventured to offer recommendations of other attorneys.

This $225,000 project has been under way for over two years to correct drainage issues along the Cerro Gordo and Floyd County border in Nora Springs. In order for the project to move forward, the railroad company needs to be notified so that they might fix their portion of the project. Cerro Gordo County Supervisors are hoping to put the project to bid by September.

During the conference call, it was made clear to Hudson the supervisor’s displeasure in his slow response time. They also agreed that if Hudson does not fulfill sending the railroad notice by the end of this week, new legal counsel would be sought.
