CC man to be retried in August in 2008 sexual abuse case
Medical records motion a ‘fishing expedition,’ county attorney says

An August trial date is set for a Charles City man whose first trial on an alleged sexual assault in 2008 ended with a deadlocked jury.
Judge Rustin Davenport scheduled the new trial for Eric Maurice Hill, 31, to begin at 9 a.m., Aug. 23, at the Floyd County Courthouse.
A pretrial conference and a hearing on evidentiary motions are scheduled to begin at 9 a.m. Aug. 8 at the Floyd County Courthouse. Hill is seeking information about the DNA analysis that linked him to the alleged crime and the victim’s medical problems that led to memory issues.
His attorney, Judith O’Donohoe, has filed two motions to produce. The first seeks the alleged victim’s medical records related to her claim on the stand in Hill’s first trial that epilepsy and a head injury in 2015 impairs her memory. The second is for information related to the DNA analysis that links him to the alleged sexual assault. Some of the requests focus on data, others on process and procedures.
Floyd County Attorney Rachel Ginbey filed a resistance to producing medical records of the alleged victim, calling the motion a fishing expedition.
Hill was tried by a jury of 12 beginning June 1 on the charge of second-degree sexual abuse. Jurors received the case on June 6 and after deliberating for about six hours, the jury deadlocked.
