Deangelo Aaron Hawkins, age 20, of Charles City, pleaded guilty to burglary in the second degree, a Class C felony, for his part in the incident along with two other men. He had originally been charged with first-degree burglary.

He was sentenced earlier this week in Floyd County District Court to five years of probation and various fines and penalties.

Judge DeDra Schroeder deferred the sentence on the request of Hawkins’ attorney and the recommendation of the Floyd County Attorney’s Office.

A deferred judgment means that if Hawkins meets the terms of his probation and pays all fines and fees, the conviction will be removed from his record.

Police reports say that Hawkins, along with Andre Leisure Johnson, age 29, of Charles CIty, and Michael Benjamin Jackson, age 20, of Charles City, broke into a home on the 400 block of B Street about 9:30 p.m. July 25, 2017.

A person who was in the home at the time hid in a closet and called 9-1-1, saying that three people, possibly armed, were in the home.

When officers arrived one person was trying to climb out a window and appeared to be armed with a weapon, that turned out to be a pellet gun, police said.

One person who was at the home at the time of the breakin was taken to the hospital and received staples for a head wound.

Jackson also entered a guilty plea to a reduced charge of second-degree burglary. He was sentenced in October to 10 years in prison, suspended; a $1,000 fine, suspended; and five years probation.

Johnson pleaded not guilty and was convicted in a Floyd County District Court jury trial of first degree burglary in October. He was sentenced in December to up to 25 years in prison.

Johnson has filed notice that he will appeal his conviction and sentence.

In addition to their other penalties, all three men were ordered to pay restitution of almost $4,600 to the victim. They are responsible for the restitution jointly and individually.
